父母与国家都对儿童的教育享有权利，但又有所区分。父母教育权的内容既及于家庭教育，也及于学校教育，包括教育选择权和学校参与权。承认并扩大父母的教育权已得到各国、地区及国际法的重视，也亟需我国教育立法的正面回应。

Both parents and the state have important rights in the education of children. But their educational rights are different. Parental right to education includes not only the right in family education but also the right in school education， including freedom of school choice as well as participation in school education. Parental right to education has universally been recognized by national， regional and international laws， but still need to be clearly stipulated in China's education laws.
