中文摘要 | 以往定義教師懲戒權的概念時,對其中的“權”沒有區分地一律表述為“權利”與“權力”。用語的含糊必然導致概念內涵與外延的不清。本文在對“權力”與“權利”進行辨析後,提出了教師懲戒權應是教師的權力,是教師的職權之一,從而明晰了教師懲戒權的概念以及相關的理論與實踐問題。 |
英文摘要 | In the past, the meaning of “power” in the concept of the punishment power of teachers is stated by power and right indiscriminately. The vague choice of words will lead to the unclear understanding of the concept’s meaning. This article differentiates and analyses the words of power and right, and argues that the punishment is teachers’ powers of office, not the right of teachers. |
