中文摘要 | 当教育政策、教育制度、教育法律或者教育行政命令明显缺乏正义的时候,教师具有良性不服从的正当性基础。但是,这并不意味着教师所有方面不服从,都能称之为良性不服从。一种不服从能够称之为良性不服从,在行动动机方面,应该主要致力于纠正明显的教育不正义;在具体行动之前,教师不能草率行事,要对不服从进行审慎思考;在行动过程中,不服从要具有公开性、说理性、非暴力特征和自愿受罚性。在教育公共生活中,良性不服从应当被视为教师的基本权利,只有如此,在实践中它才能够得到应有尊重。 |
英文摘要 | Teachers have the legitimacy of the benign disobedience if some educational policies, systems, laws or executive orders show a noticeable lack of justice. But it doesn’t mean that all the resistance from the teachers can be called benign disobedience. If a resistance can be called benign disobedience, it must try to correct obvious educational injustice in its motivation; teachers cannot act recklessly and should take careful thought about the resistance before act; it must have the characters of openness, argument, non-violence and accepting penalty voluntarily in the course of action. Benign disobedience should be regarded as the basic rights of teachers in educational public life. And only thus can it be respected in practice. |
