桃園地區性侵害加害人之再犯風險評估相關因子探討

The Recidivism Evaluation and Associated Factors for Sexual Offenders of Taoyuan County

本研究目的為探討桃園地區性侵害加害人之再犯風險評估相關因子。由桃園縣（市）2011∼2013年資料庫裡以及某監獄選出指標犯行為性犯罪的受刑人，且至少涉及一件性犯罪案件。每位加害人均蒐集其Static-99之分數，以及評估加害人在「穩定動態危險因子」與「急性動態危險因子」危險程度之記錄。研究結果發現控制干擾因子後，曾有多次性侵害犯罪史等各項指標均會造成穩定動態危險總分的增加，特別是「無（低）意願接受治療」增加最多，只有「願負起犯罪責任」會使穩定危險指標分數下降。在急性動態危險總分方面，「語言理解能力尚可」及「年齡在40歲以下」其急性動態危險總分較低，其他如「曾有多次性侵害犯罪史」等指標則是會造成急性動態危險總分增加，特別是「曾有多次性侵害犯罪史」上升幅度最大。在Static-99總分方面，「過去學校經驗適應不佳」其Static-99指標分數增加最多。性侵害加害人再犯風險評估除了協助司法判定性侵害加害人的處遇，更應該與相關治療程序密切結合，使矯正機關善用有限資源將強制治療發揮最大效益。

This study’s purpose is to explore the recidivism evaluation and associated factors for sexual offenders of Taoyuan County. The target offenders with index of offense as sexual offenses were selected in Taoyuan between 2011 and 2013. The data of Static-99, scores of stable dynamic risk factors, and scores of acute dynamic risk factors were collected. Results is that after adjustment for interfering factors, having many sexual crime histories could increase the stable dynamic risk scores. In particular, “no (low) willingness to receive treatment” increased the most. Among other factors, only “willing to take responsibility for crime” will result in a decreased stable dynamic risk scores. For the acute dynamic risk scores, factors included “language comprehension is acceptable” and “age below 40.” Having many sexual crime histories increased the stable dynamic risk scores the most. In addition, the most important factor related to Static-99 was “poor adjustment of school experience in the past.” In addition to helping the judiciary to determine the treatment of sexual offenders, the recidivism evaluation should be closely related to the relevant treatment procedures so that the correction facilities could make best use of limited resources to strengthen the maximum benefit of the compulsory treatment.
