共同治理视角下我国高校法人所有权及其治理机制的构建

The Establishment of Corporate Ownership and Governance Mechanism for Chinese Universities: The Perspective of Common Governance

For a long time， due to the slow transformation of government functions and the absence of corporate property right conception and so on， the reform of property right system featured by the separation of ownership and management under the leadership of government has led to the empty state of university's corporate property rights and more stringent corporate property rights controlled by contributors. In a market economy， it is fundamental to the establishment of university's corporate status to endow university corporate with complete property rights to the school property， and bear civil liabilities independently limited to the school property. In order to establish the property ownership of university and finally realize university autonomy， it is imperative to clearly define the connotations of corporate ownership， to clarify the relationship of rights and duties between investors and school corporate， and to establish common governance mechanism based on corporate ownership.
