College Students' Participation Right in University Governance: Theoretical Basis and Realistic Expression

As college students' participation right in university governance is not expressed clearly in current legislation， universities tend to follow the conventional thinking mode on university management when locating the position of college students in university governance. As a result， college students' participation right is in vein in university governance. In order to realize college students' participation right， it is imperative to formulate government power list in the legal system so as to achieve genuine university autonomy， to establish a complete set of mechanisms and relief system to match students' participation right， and to establish a negative list to prevent right abuse. The legal guarantee for students' participation right is not only conducive to the cultivation of college students' consciousness to exercise rights properly and the democratization and legalization of university's decision-making during the transitional period， but also in accordance with the inner demands of the laws of education development.
