英文摘要 | In January 2011,the Grand Justices Council in the Judicial Yuan of Taiwan,China,issued Interpretation 684,which partially replaces Interpretation 382 and expands the cause of action for college students.This new interpretation undermines the distinction between fundamental relationship and management relationship,a legal standard previously used in education law research.With Interpretation 684,the special authority relation theory can hardly explain university-student relationship.This new interpretation has already had and will continue to have profound impact on education law theory,judicial practice and higher education administration in Taiwan.Scholars and policy markers in Mainland China should closely follow and carefully analyze these changes so as to improve the judicial remedy system available for university students in Mainland. |
