中文摘要 | 高校在制定内部规则时,应当体现和追求秩序、效率与公平的价值取向。但当前高校内部规则存在着设定主体权限划分不明确、规则制定缺乏监督、设定内容存在着不合法性、设定形式不规范、设定程序严重缺失、自由裁量权界限模糊、概括条款和类推原则滥设等方面的合法性缺失现象。高校内部规则完善的现实出路在于:在制定过程中要体现主体、职权、程序的法定,遵循权力制衡原则、法律保留原则;在实施过程中要遵循比例原则、正当程序原则;在司法过程中,应遵循有限司法审查原则。 |
英文摘要 | Tertiary institutions gain the legality purview of prescribing their internal rules by the contents of laws and regulations,administrative regulations and so on.Order,efficiency and justice should be embodied and pursued when universities and colleges set rules.At present,their is a lack of legitimacy in the internal administrative regulations of tertiary institutions,such as the subject jurisdiction dividing not definitely,the established rule lacking supervision,the established contents illegal,the form nonstandard,the procedure seriously imperfect,the tertiary institutions,freedom right vague,general item and analogy principle excessively set up.The law control of the tertiary institutions,internal rules should embody subject,authority,legal procedure and follow the power balance principle,law withhold principle and law priority principle.When implementing these rules,the universities and colleges should follow proportion principle,legal procedure principle and limited judicial review principle. |
