立法缺位状态下公立高校纠纷解决的路径分析

Dispute Resolution Approaches in Public Colleges and Universities under the State of Legislation Vacancy

受诸多方面因素的影响，高校管理领域存在着立法缺位的现象，这种现象直到教育部2003年提出依法治校之后也并没有从根本上消失。高校发生的诸种管理纠纷就是置身于这种场景之下的。司法是解决高校行政纠纷的一种重要手段，但是它在解决纠纷时面临着许多突出的问题。对该类纠纷的根本性解决，不能单纯依靠司法审查制度，而应该在完善司法审查制度的同时，探求更为根本的路径。

Due to multiple factors，there exists the phenomenon of legislation vacancy in university management，which has not totally disappeared even after the Ministry of Education put forward the theory of legal administration of school in 2003.Most of the college management conflicts are due to this root cause.Judicature is one of the most useful methods to solve this kind of conflicts.However，there still exist many unavoidable problems in it.To absolutely terminate these problems，it is imperative to search for the more fundamental way while striving to improve the judicial review system.
