臺灣技術及職業教育法芻議

Draft Proposal for Technical and Vocational Education Law in Taiwan

我國技術及職業教育之立法， 自1985年啟動，期間歷經1988年《技術及職業教育法》草案、1999年《技術及職業校院法》草案、2001年《技術及職業校院法》草案、2004年《技術及職業校院法》草案、2009年《技術及職業校院法》草案，至2013年《技術及職業教育法》草案，已近30年之歷程。為確立技職教育之內涵及探索立法之必要性，本文運用文件分析法及文獻分析，先整理我國技職教育立法研修歷程，再就當前技職教育所面臨之問題進行歸納，並就現行法律是否有助於彰顯技職教育務實致用特色，予以檢視後，再探討美國、德國、日本及韓國技職教育相關法制，以利借鏡；最後，再據以提出我國《技術及職業教育法》草案內容之重點，以利草案條文研擬，建構我國《技術及職業教育法》。

The draft of Technical and Vocational Education Law was proposed since 1985. During 1988 to 2013, the name of Law was changed to the Technical and Vocational Education School Law. Unfortunately, those advocate holding could not persuade the authorities into legislate. In order to provide the necessity of legislation, this article applied the document analysis and literature review to explore the straits of technical and vocational education in Taiwan, and to extract the merits of other countries’ related laws, like United States, Germany, Japan and Korea. Finally, the content of the Technical and Vocational Education Law was stated.
