英文摘要 | The evolution of the legal status of public university in the era of globalization displays the modern features with homogeneous nature and heterogeneous form. On the one hand, with a clear boundary set between public sector and private sector and the independent value of public law reaffirmed, the role of public law in safeguarding public welfare at public universities is recognized. Public Corporation in the broad sense(including public institutions)is the consensus on the legal status of public universities around the world. On the other hand, the differences in legal traditions, legislative techniques and philosophical connotations between Continental Legal System and Anglo-Saxon Legal System result in the relative uniqueness of the legal status of public universities in different nations. The merge between public law and private law is reflected by the update of public corporation system and the adjustment of property of public legal system in Continental Legal System and by the expansion of the scope of public law and the enhancing trend of public law regulation in Anglo-Saxon Legal System. The“mixed legal regulation”of public and private sector will be the legal framework for public university governance around the world. The evolution of the legal status of public universities will gradually transform the legal relationship between public university and government and the legal relationship within public university, and ease the inherent tension between legitimacy and effectiveness as well as between publicity and autonomy in public university governance. |
