台湾地区陆生政策与相关规定体系构建之间的互动为探讨教育政策合法化的程序、规范以及价值观提供了样本。重大教育政策只有完成合法化才有可能获得正当性,大量无视合法化规范的政策活动已经使教育法制建设停滞。教育法治条件下,所有政策活动必须有法律授权与法源支持,在法律制度体系和框架下进行。教育政策必须重视合法化问题。

The interaction between the Taiwan recruitment policy for mainland students and related construction of laws and regulations system,providing a sample for studying the procedure,standard and values of education policy legalization.Significant education policies must be legalized.A large number of policy activities that ignoring the legalization have made the construction of education legal system stagnated.Under the condition of education governed by law,all of the policy activities must have legal authorization and source of law support,in the framework of legal system.Education policy must pay attention to the question of legalized.
