美国公立中小学校惩戒权的司法监督是教育法治的重要领域。从对基本权利的宪法性保障角度出发，本文对惩戒权司法监督的内容进行了梳理，力图澄清其法治原理，并结合体罚、停学惩戒方面的重要判例，介绍了惩戒权制度司法审查的特征、审查的对象与审查的标准。

The judicial supervision of punishment power of the public schools in U.S. is an important part of the educational legislation. From the perspective of the constitutional protection of the Basic-Right， the paper tries to examine the concepts and contents of judicial supervision of punishment power and clarify the questions in the law principles including the characteristics， the objects and the standards of the judicial supervision of punishment power.
