我国高教法治现状分析———基于高教诉讼案件的视角（2010-2015）

The Current Status of Rule of Law in Chinese HEIs: An Analysis of Lawsuits Concerning Higher Education between 2010 and 2015

Through analysis of more than 300 lawsuits concerning higher education from 2010 to 2015， the authors conclude that lawsuit numbers in higher education increase annually， the scope of controversy expand gradually， and disputes between higher education institutions （HEIs） and teachers & students are the most prevalent form among all. Problems of the rule of law in HEIs are identified as follows: self-developed regulations and systems in conflict with statutes on student management issues， lack of standardized procedure for power execution on teacher management issues， and failing to actively fulfill the legal obligation of information disclosure. HEIs are supposed to attach importance to lawsuits and enhance the level of rule of law from the perspectives of idea， institution and procedure.
