中文摘要 | 权力清单制度是促进政府职能转变、实现政府简政放权的一种有效手段。本文通过对国家教育行政权力清单的规范研究认为:依法梳理、设定教育行政部门职权边界是教育行政权力清单制度的基础;教育行政权力清单不仅应包括在法律法规基础上梳理出来的权力事项目录,更为重要的还应包括与事项目录相对应的事项详单;教育行政部门应当以责任清单的形式构建权力运行的内部审查机制以及权力被滥用之后的法律追究机制,以形成对教育行政权力运行的法律威慑,确保其行使的合法性和合理性。 |
英文摘要 | The system of power list is an effective means to promote the transformation of government functions and government decentralization. Through the study of the national education's administrative power list, this paper puts forward three conclusions. Firstly, ruling of the law and by the law is the basis of the power list system. Secondly, the list of administrative power in education should include not only directories sorted out by laws and regulations but also detailed information corresponding to the directories. Thirdly, the authority in educational administration should build up internal mechanisms to supervise the exercise of power and to pursue legal actions in case of abuse of power, in order to ensure the legitimate and rational exercise of power. |
