中文摘要 | 随着我国教育事业的蓬勃发展,学生人数逐年增多,学生事故也呈频发态势。由于处理学生事故缺少对口、细化的法律依据,法院在处理过程中难免定性不准、标准不一。学生根据其年龄差异,属于不同类型的行为能力人,应以这一标准为依据划分学校的管理标准与责任范围。加强学生事故方面的立法研究工作,理清学校和学生之间的法律关系,确定针对培养不同年龄阶段的学生学校所适用的归责原则,明晰学校的管理职责,从源头上减少这类事件的发生是学生事故风险防范的重要内容。 |
英文摘要 | In recent years, with the expansion of school's enrollment, student accidents became popular, which caused a tremendous impact on students' families. After the disaster, no matter how parents tend to be the first to bear the brunt to school, in view of the school, which seriously affected the healthy development of the school normal teaching order management and education. Due to lack of legal basis and student injury accidents counterparts, refinement, the court in the process is often inaccurate, not at a qualitative standard. Students according to their age difference, belong to different types of person capacity. The court should take this standard as the qualitative basis. This paper gives a discussion on the legal relationship between the school and the students. The students at different levels should apply the principle of attribution of responsibility. In order to clear division of school and students, the school education law has become necessary and urgent for research. Legislation for students' accidents becomes the important content of risk prevention of accidents from the source to reduce the occurrence of these events. |
