中文摘要 | 建设学分银行,搭建各级各类教育纵向衔接、横向沟通的终身教育“立交桥冶,已经成为我国构建终身教育体系、建设学习型社会的基本共识与重大战略决策。然而在实际操作过程中,学分银行的建设并没有得到法律的保障和约束,而是在各级地方政府的委托中进行,于是学分银行建设陷入缺乏法律授权、机构重叠、资源浪费、公信力欠缺等困境。那么,立法为何对于学分银行建设至关重要,缺失法律授权的学分银行又将遭遇怎样的问题与困境,无法律授权获取的文凭其合法性和有效性又在哪里? 本文基于国际经验以及对本土实践的分析,对学分银行的立法与运作内容提出了若干建议与对策。 |
英文摘要 | Constructing credit bank System,setting up an "overpass" among all types and all levels of education,has become the basic consensus and major strategic decisions to realize lifelong education system and learning society,where every citizen can enjoy lifelong education. However,with the lack of legal protection and constraints,the current construction has felt into the predicament of lack of legal authority,organizational overlapping,resource waste and credibility. Here are some questions to ponder: why is legislative crucial to credit bank construction? What kind of problems and difficulties will encounter without legislative leading? How to ensure the legitimacy and effectiveness of the diploma obtained through credit bank system? This article trys to explain the significance of credit bank construction legislation based on international experience and the analysis of local practice. |
