| 中文摘要 | 本文透過文獻分析,旨在由司法審查的觀點探討中小學教師的專業自主。首先探討教師專業自主在法律上的地位,其次討論不確定法律概念、判斷餘地與司法審查等法律名詞之意涵與其在教育領域上的運用。最後以法院之判例,探討司法審查教師專業自主的分際,釐清教師專業自主的範圍。希冀教師從事教學活動時,在不逾越法律分際的前提下,充分地展現教師的專業自主,提升教師的專業地位與尊嚴。 |
| 英文摘要 | Through the analysis of related articles, this study discussed the professional autonomy of teachers in the elementary and secondary school with the perspective of judicial review. This study discussed three concepts. First, how is the legal status of the professional autonomy of teachers? Second, what is the meaning of indefinite legal concept, authorized discretion and judicial review, and how these are applied in education. Finally, providing court cases to explore how the judiciary examines the professional autonomy of teachers, and clarify the scope of professional autonomy of teachers. We hope teachers can fully show their autonomy and enhance their expertise and dignity under the circumstances of not violating the law during their teaching. |
