法律地位视域中的民办学校分类管理

民办学校的多样化发展,使其法律地位问题呈现出一定的复杂性,不能一概而论。从事学制教育的民办学校在依教育法履行公共教育职能时具有公法地位;而从事非学制教育的民办学校则不具公法地位。现实中的民办学校是否具有公法地位,与营利与否并非一一对应的关系。在民办学校分类管理过程中,需综合考虑其法律地位与营利性两个维度,统筹采用精细、公平、合理的管理措施。

The diversified development of private schools has caused some complexities in the legal status of private schools,making generalization impossible.Private schools that fulfill the functions of public education in school system education in accordance with the Education Act have public law status while those not in school system education do not.There is no one-to-one relationship between whether aprivate school has public law status and whether the school is for-profit.In the private school classification management,we should take both into account and take fine,fair and reasonable management measures.
