中文摘要 | 本文就大法官釋字第372號所衍生的教師工會,了解其與教師會的性質差異,進而探究教師會與教師工會相關法律爭議。首先,就憲法探究教師會與教師工會的特徵及教師與國家法律的關係,進而就教師會與教師工會在法令適用對象、權力義務內涵、成員入會與受惠對象及申訴制度管道等內涵初探其法律爭議事項,進而提出相關建議事項,以作為教育相關單位之參考。 |
英文摘要 | The purpose of this article is from the view of the perspective of J.Y.Interpretation No.372 to explain the difference of content of teachers' association and teachers' union and to explore the legal disputes of teachers' association and teachers' union. First of all, analyze the lierature of Constitution content to explore the characteristics and relationship of the teachers' association and teachers' union. And next, according to the ideals of the teachers' association and teachers' union's law bring up some new agreement for that include person, rights, attendent and complaints, etc. The implication of the results for school educator are disscussed. |
