GHM理论视角下的教育产权制度问题及对策

Problems and Reforms of Educational Property Rights Institutions Based on the GHM Theory

利用现任产权理论，通过对GHM理论的扩展分析，文章将剩余控制权分为名义剩余控制权与实际剩余控制权，并以此探讨我国教育产权制度存在的问题。指出我国目前教育产权制度设计的内在矛盾主要表现为：实际剩余控制权与剩余索取权的不对称，名义剩余控制权的不完全，以及由此产生的预算软约束、委托代理寻租等问题。在此基础上，给出了教育产权制度改革的对策建议。

With modern property rights theory， this paper expands GHM theory， and classified the residual control right into nominal residual control right and real residual control right. From this point of view， this paper analyzes the defects of our actual educational property rights， points out that the illogicalities in educational property rights system including the asymmetry between nominal and real residual control right， inadequacy of nominal residual control right， soft budget constraint， principal─agent problem as well as rent seeking problem. Based on the analysis， this paper presents some suggestions pertinent to reform and innovate the educational property rights system.
