高校权力的法治关照

A Study of Power of Colleges and Universities from the View of Law-making

高校法治建设尤为突显其制度的型构，而制度的设定前提和运作形式则以权力形态予以表征，权力在高校法治建设中不可回避。但是，现行的理论研究对于高校权力的分析存在诸多弊端，一定程度上混淆“权力”范畴的本义，从而导致本已困惑众生的实践更加迷茫。只有重新梳理理论研究的现状，对高校权力的内涵进行重新界定，才能真正解析法治观照下的高校权力。

The system construction is especially elaborated in building rule of law to colleges and universities， and system’s premise and form request powers as their embodies， so power is unavoidable in building rule of law to colleges and universities. However， the existing theories on powers of this field show many drawbacks， and confuse connotation of power to some extents， and further mislead the confused practice. Only by the way of re-classifying and judging the present theories and re-defining its connotation， can we truly expound power of colleges and universities.
