大學法改革的彳亍徘徊--修法政策轉折與修正結果的檢討

The Lingering and Tardiness of the University of Law Reformation : The Reflection upon the Turning Points of Policy and the Results of Amendment

本文首先回顧《大學法》此次（2005）全文修正之修法過程，並比較2003年《大學法》修正草案與2005年《大學法》修正草案中政策方向之轉變，分析兩種草案間之差異，並與最後之立法結果做一檢討分析，發現教育部在政策方向之調整上，係受到立法院的壓力及希望儘速完成立法之影響，最後在若干重要之高等教育政策上，做了讓步與妥協，但最後之立法結果，仍然未完全如教育部的預期而有落差。\r其次，本文對於這些有關重要高等教育政策之爭議問題，包括公立大學法人化、大學校長遴選方式、大學之決策型態，以及大學學術與行政組織之調整等四個部分，與鄰近日本剛完成的國立大學法人化之改革做一比較，分析其異同，並就這些問題提出本文的看法。最後，本文認為教育部應有主導高等教育政策之擔當，為政策之提出負決策責任。至於立法院若欲變更教育部之高等教育政策，應基於明確之民意根據或理由，以便向全體國民負政治責任。

First of all， the study aimed to review the process of the amendment for “University Law” in 2005 in Taiwan， to compare the changes of the policy by analyzing the differences between the amendments in 2003 and 2005， and to examine the final legislative results. It was found that changes of policies from the Ministry of Education (MOE) were influenced by the Legislative Yuan， so the law could not achieve the expectation of MOE about certain higher education policies.Secondly， this study examined several controversial issues of higher education， such as the incorporation of public universities， the election of president in universities， the procedure for decision-making in universi-ties， and the restructuringt of academic and administrative organizations， by comparing with Japanese universities that were recently incorporated. Finally， the study argued that MOE should play a leading role in strategy-managing of higher education and take the responsibility of decision-making. In order to fulfill the political responsibility for the general public， the intention of Legislative Yuan to change the policy made by MOE should be based on concrete public opinions or reasons.
