现代大学治理的法权结构

The Structure of Legal Rights in Modern University Governance

法权是法定之权，是制度化的权力或权利，各类法权相互联系形成法权结构。大学法权有其特殊的构成，其理想追求是权力与权力相互制衡、权力与权利良性互动。我国大学治理结构的完善，必须通过法律对大学的各类法权要素进行有效配置，形成彼此协调的横向结构和上下有序的纵向结构，使大学走向秩序和自由的现代大学。

Legal right is the power or right affirmed by law. The structure of legal rights is composed of all kinds of legal relationships. Legal rights in modern university form a special structure， whose ideal pattern is the checks and balances of power， and the benign interaction between power and right. To improve university's governance system， it is imperative to establish an orderly horizontal structure and a coordinated vertical structure through the effective distribution of legal right elements within university.
