韩国禁止“先行教育”的立法研究

Research on Legislation of Prohibiting Advance Education in Korea

韩国于2014年3月出台了《推进公共教育正常化及先行教育规制特别法》，目的是 促进公共教育正常化，消除“先行教育”对韩国社会造成的严重不良影响，并实现学校应有的教 育目标:培养学生之才能、激发学生创造力。此次立法直接禁止公共教育机构进行“先行教育”， 并改革了中小学考试及大学招生考试制度，但对于私立补习班仅规定不得对“先行教育”进行 广告和宣传，未直接禁止其实施“先行教育”。韩国各界对此次立法存在的不足进行了评议，担 心立法的不完善可能影响法律实施效果。

In March 2014，South Korea introduced a legislation on the ban of leading education，the purpose of the legislation is to promote the normalization of public education，eliminate the bad influence of leading education to the society， and cultivate the students' ability and stimulate students' creativity. This is South Korea's education goals. According to the regulation， the government banned public education institutions to implement the leading education first， it also reformed examination system of school and the university enrollment system. According to the law，however， it allows private cram school to carry out the leading education，but cannot go for advertising and promotions. People from all walks of life in South Korea put forward different opinions on the legislation ，people think that because of the deficiency in the system of law，it may affect the implementation effect of the legeslation.
