中文摘要 | 我国大陆的择校主要体现为一种由广大家长自下而上发起,以金钱、关系以及权力等方式竞逐(原)公立(重点)学校优质学额的现象。情理法兼顾是我国择校文化的消解方式。导致这种现象的一个很重要的原因在于我国处于由“人治”向法治转型期,公共的法律意识还有待提升、法治的根基不牢、政府执法能力有待完善。英国则是在法治背景下,以就近入学为基准,将择校作为公民的一项权利,以法律形式引导家长和学生择校,择校立法循序渐进。 |
英文摘要 | School choice of mainland China is mainly in the way of bottom-up initiated by the majority of parents who compete for high quality (former) public (key) schools by means of money, personal relationship, and power etc.. Taking account of the ethic of human relationship and the law is the settlement of school choice from culture perspective in China. A very important reason of the phenomenon is that now China is in the transition period from "rule of man" to the rule of law. Public law awareness needs to be raised, the basis for the rule of law must be strengthened, and the government's capability should be improved. In the context of the rule of law, the UK government emphasizes the rule of entering school according to catchment, affords citizens the right of school choice, and guides parents and students to choose school according to law. School choice legislation has developed gradually in UK. |
